2. SPONSOR: The Sweepstakes is sponsored by Transitions Optical, Inc., 1575 Bishop Street North, Suite 200 Cambridge Ontario N1R 7J4.
3. ELIGIBILITY: The Contest is open to legal residents of Canada who are eighteen (18) years of age or older at time of entry. Contest is not open to Sponsor’s employees, directors, representatives, advisors and agents or those of Sponsor’s parent companies, affiliates, subsidiaries or advertising or promotional agencies , or to the immediate family members of, or to any persons domiciled with, any of the foregoing persons. All winners are subject to Sponsor's verification of his or her eligibility to participate.
4. ENTRY PERIOD: The Contest will begin at 12:01 a.m. (EST) on January 1, 2010 and end at 11:59 p.m. (EST) on December 31, 2010 or upon written notification from Transitions. Notification will be posted at www.transitions.com/registermylenses.
5. HOW TO ENTER: There are two ways participants can enter. Entry limitations: Maximum of one (1) entry per person per day during the Entry Period, regardless of method of entry used.
A. Enter By Mail: To enter by mail, complete the official entry form received with your Transitions Lenses Certificate of Authenticity, or hand-print on a 3 1/2”x 5 1/2” piece of paper your name, address, city, state, zip code, daytime phone number (where you can be reached during normal business hours), birth date and the words Transitions Register My Lenses. All mail-in entries must be mailed to: Transitions Register My Lenses, PO Box 43149 RPO Parkway West, Mississauga, ON L5B 9Z9 . No photocopies, mechanical reproductions, altered, illegible, incomplete, mutilated, postage-due or forged entries will be accepted. Sponsor is not responsible for lost, delayed, mutilated or misdirected mail.
B. Enter Online: To enter online, access the Internet
website at http://www.transitions.com/registermylenses and complete the
official online entry form in its entirety. Submit your entry by clicking on
the “Submit” button. No more than one (1) online entry per day may be
registered from the same computer terminal or from the same individual.
Entrants may not enter with multiple e-mail and/or multiple identities. Any
entrant who attempts to submit more than one entry per day using multiple
e-mail and/or multiple identities or uses any device or artifice may be
disqualified. Once submitted, an entry cannot be modified, returned or deleted.
In the event of a dispute in connection with the identity of the individual who
submitted an online entry, the entry will be deemed to have been submitted by
the authorized account holder of the e-mail account identified on the online
entry form. The authorized account holder is deemed to be the natural person
who is assigned to an e-mail address by an Internet access provider, service
provider, or other online organization that is responsible for assigning e-mail
addresses for the domain associated with the submitted e-mail address. If an
eligible individual cannot be determined and verified in the manner described
above, the entry will be disqualified as null and void and an alternate winner
will be selected. Any use of robotic, automatic, macro, programmed or like
entry methods will void all such entries by such methods and persons
determined, in Sponsor's sole discretion, to have used any such methods and
such persons will be disqualified from further participation in the Conest. ANY
ENTRY WHICH DOES NOT CONFORM STRICTLY TO THESE REQUIREMENTS IS NULL AND VOID.
All entries become the property of Sponsor and none will be returned.
6. SWEEPSTAKES PRIZES & ODDS OF WINNING: Grand Prize: (12)
Twelve to be awarded. Reimbursement of retail purchase price of winner’s
eyeglasses fitted with Transitions Lenses. Maximum reimbursement not to exceed
$500.00. Prizes are non-assignable and nontransferable. Odds of
winning dependant upon the number of eligible entries received. ALL CONTEST
PRIZES WILL BE AWARDED. In the event the winner did not purchase eyeglasses
fitted with Transitions Lenses the winner will be awarded the average retail
price of $300.00 in the form of a cheque.
7. DRAWINGS: All winners will be selected in random drawings
conducted by an independent judging organization as outlined below:
On or about the following dates: 2/01/2010, 3/01/2010, 4/01/2010, 5/01/2010, 6/01/2010,
7/01/2010, 8/01/2010, 9/01/2010, 10/01/2010, 11/01/2010, 12/01/2010, 1/01/2011.
A drawing will be conducted from all entries received. Each drawing date will
determine one (1) Grand Prize Winner. All winners will be notified by mail.
Winners may be required to claim their prize by completing and signing an
affidavit of eligibility, a liability release form, skill testing question and a
publicity release. In the event of non compliance with these requirements, an
alternate winner will be selected, with no further compensation. If
notification of prize award is returned to Sponsor, as undeliverable, the prize
will be awarded to an alternate winner, with no further compensation.
Winners may waive the right to receive a prize. The return of any prize or
prize notification as undeliverable will result in disqualification, the
forfeiture of all interest in the prize, and selection of a substitute winner
from among all remaining eligible entries. Unless prohibited by law, acceptance
of a prize constitutes permission for the Sponsor and its agencies to use the
Winner’s name, address (city and province) and/or likeness for advertising and
trade purposes without further compensation, worldwide and in perpetuity, in
any and all forms of media, now known and hereafter devised, including without
limitation the Internet.
8. GENERAL CONDITIONS: By entering, participants agree to
be bound by these Official Rules and by the decisions of Sponsor and Contest
judges appointed by Sponsor, which shall be final and binding in all respects.
Sponsor reserves the right in its sole discretion to disqualify any individual
it finds to be tampering with the entry process or the operation of the Contest
or web site or to be acting in violation of these Official Rules or in an
un-sportsmanlike or disruptive manner. Any person attempting to defraud or in
any way tamper with this Contest will be ineligible for prizes. In the event
that any tampering, fraud, virus, bug, technical error or failure, unauthorized
intervention, or other problem which corrupts or affects the administration,
security, fairness, integrity of the online portion of the Contest, or for any
reason Sponsor deems it necessary, the Sponsor may at its sole discretion
cancel, terminate, modify or suspend the online portion of the Contest and
award any remaining prizes at random among all eligible entries received up to
the time of impairment. Should the Contest be cancelled or altered prior to the
stated expiration date, notice will be posted at http://www.transitions.com/registermylenses.
CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE
LEGITIMATE OPERATION OF THE CONTEST OR INSTANT WIN PORTION OF THIS PROMOTIONAL
CAMPIAGN IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT
BE MADE, THE SPONSOR RESERVES THE RIGHT TO PROSECUTE AND SEEK DAMAGES OR OTHER
REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST
EXTENT PERMITTED BY LAW.
9. DISCLAIMERS: By entering, participants acknowledge and
agree that the Sponsor, Transitions Optical Inc., and their respective parents,
subsidiaries, affiliates, franchisees, advertising and promotional agencies and
the officers, directors, employees, agents and representatives of each of the
foregoing companies (collectively, the “Contest Entities”), will not be liable
for losses or injuries of any kind resulting from acceptance/possession/use
and/or misuse of prize(s), travel to and from any prize-related activity,
participation in the Contest, printing, mailing or distribution errors, or any
malfunctions of the computer Internet system, computer dating mechanism,
computer equipment, software, or any combination thereof, unauthorized human
intervention in the Contest, for errors in the administration of the Contest or
the processing of entries, or for any entries that are late (including delayed
data transmissions), tampered with, garbled, incomplete, or otherwise not in
compliance with these Official Rules. Contest Entities are not responsible or
liable for any injury or damage to any participant’s or third person’s computer
and/or its contents, related to or resulting from Contest. Participants release
and agree to hold harmless Contest Entities from any and all liability from any
of the claims described above.
Sponsor assumes no responsibility for any error, omission, interruption,
deletion, defect, delay in operation or transmission, communications line
failure, theft or destruction or unauthorized access to its web sites. Sponsor
is not responsible for any problems or technical malfunction of any
telecommunications network or telecommunication lines, computer on-line
systems, servers, computer equipment, telecommunications network equipment,
software, failure of any e-mail or entry to be received by Sponsor on account
of technical problems, human error or traffic congestion on the Internet or on
any web site, or any combination thereof.
IN NO EVENT WILL ANY CONTEST ENTITY BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR
LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR
PUNITIVE DAMAGES ARISING OUT OF YOUR ENTRY IN, AND PARTICIPATION, IN THE CONTEST
OR THE DOWNLOADING AND/OR PRINTING OF MATERIAL ASSOCIATED WITH THE CONTEST.
WITHOUT LIMITING THE FOREGOING, EVERYTHING ON THIS SITE AND IN THIS PROMOTION
IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR

Prize Winner’s (available after 2/15/2010), and/or a copy of these Official
Rules, send a self-addressed, stamped business-size envelope to Transitions Register

Promotions Department. Indicate whether you are requesting the Winners list or
a copy of Official Rules or any combination of the foregoing.
11. FOR QUEBEC RESIDENTS ONLY: Any dispute respecting the conduct or organization of a publicity contest maybe submitted to the Regie des alcools, des courses et des jeux du Quebec for a ruling. Any litigation respecting the awarding of a prize maybe submitted to the Regie only for the sole purpose of helping the parties reach a settlement.
